Terms and Conditions for Elevator Speech Training Referral Program

Welcome to Elevator Speech Training Referral Program. By participating in this program, you agree to comply with the following terms and conditions. Please read them carefully.

1. Introduction

The Referral Program (“Program”) is designed to reward participants (“Referrers”) who refer new clients (“Referred Clients”) to Elevator Speech Training services.

2. Eligibility

  1. Participants: The Program is open to individuals who are 18 years of age or older. Employees, contractors, and family members of Marc Fest and affiliated companies are not eligible to participate.

3. How to Refer

  1. Referral Submission: To refer a new client, send an introduction email to, introducing yourself, Marc Fest, and the Referred Client.
  2. Duplicate Referrals: In the event that multiple Referrers refer the same client, the incentive will be awarded to the Referrer whose referral email was received first, based on the email timestamp.

4. Referral Incentives

  1. Incentive Options:
    • Option A: A donation in your name to your chosen non-profit.
    • Option B: A cash bonus via check, PayPal, or Venmo.
    • Option C: Two complimentary one-hour Elevator Speech Training sessions with Marc Fest.
    • Option D: A custom incentive co-created to suit your needs.
  2. Incentive Amount: The bonus and donation amounts will be 5% of the contracted consulting fee, up to $10,000, paid within 90 days of receiving payment from the new client.
  3. Optional Incentives: Referrers may choose to waive the referral incentive if they prefer not to receive it.

5. Incentive Distribution

  1. Notification: Marc Fest will confirm your chosen incentive and notify you when it has been distributed.
  2. Scheduling: If you choose the complimentary Elevator Speech Training sessions, arrangements will be made to schedule them.

6. Referral Validity

  1. Other Introductions: Referrers will not be eligible for a referral incentive if the contract with the new client occurs due to another introduction or interaction unrelated to the referral email submitted by the Referrer.

7. Tax Implications

  1. Tax Reporting: Cash bonuses and other monetary incentives may be considered taxable income. Referrers are responsible for any taxes associated with referral incentives. Please consult a tax professional for advice.
  2. Non-Cash Incentives: Non-cash incentives, such as complimentary services, may also have tax implications.

8. Data Privacy

  1. Consent: By participating in the Program, Referrers consent to the collection and use of their personal information for the purposes of administering the Program.
  2. Compliance: Marc Fest complies with data protection laws, including GDPR and CCPA. Personal information will not be shared with third parties without consent.

9. Ethical Considerations

  1. Fairness: The Program must be conducted ethically. Practices perceived as bribery or undue influence are prohibited.
  2. Non-Profit Donations: Ensure that donations to non-profits do not create conflicts of interest, especially if the Referrer is associated with the non-profit.
  3. Internal Referrals: Referrals within the same organization will not be eligible for a referral incentive to avoid any appearance of conflict of interest.

10. Dispute Resolution

  1. Verification: All referrals will be verified for authenticity and intent.
  2. Final Decision: Marc Fest reserves the right to review all relevant communications and make a final decision in case of disputes. In exceptional cases, the incentive may be split at Marc Fest’s discretion. All decisions made by Marc Fest in these matters are final.

11. General Conditions

  1. Modification: Marc Fest reserves the right to modify or terminate the Program at any time without prior notice.
  2. Governing Law: These terms and conditions are governed by the laws of the state of Florida. Any disputes arising under these terms will be resolved in the state or federal courts located in Florida.
  3. Limitation of Liability: Marc Fest will not be liable for any damages arising from the participation in the Program or the use of referral incentives.
